Sale of the FitzPatrick plant from Entergy to Exelon Corp. was approved by commission members 4-0. Final sale of the $110 million, 838-megawatt plant still needs approval of the federal Nuclear Regulatory Commission and Federal Energy Regulatory Commission. "Our finding today is that the public will be well-served by the transfer of ownership of FitzPatrick," Commission Chair Audrey Zibelman said in a prepared statement after the vote. The deal calls for what could be 12 years of state subsidies worth $7.6 billion to the plant's new owners, who have said that low natural gas prices and other factors make it uneconomical to run without government support.

The deal has raised controversy with anti-nuclear activists and those who question the need for subsidies, saying they don't believe the facility is worth saving. Had Entergy not found a buyer, it was planning to close the plant, which employs 600 well-paid, largely unionized, skilled workers. They would be hard-pressed to find comparable work in the economically struggling region around Oswego County. Located in the town of Scriba, the plant generates enough electricity to power more than 800,000 average sized homes without generating carbon emissions, according to the PSC. Commission members and staffers say that using nuclear power allows the state to meet its goal of sharply reducing greenhouse gas emissions. And it can serve as a bridge while the state moves toward more reliance on alternative energy sources. Still, opponents including NYPIRG and the Alliance for Clean Energy, held one of what have been several press conferences against the proposed sale on Thursday morning, just as the PSC was getting ready to meet.

They offered a study contending that the subsidies to keep FitzPatrick open would be better used to help develop more renewable energy sources, such as wind and solar. They pointed out that the subsidies would be spread out among utility customers statewide. And they noted that they don't know all the details of the subsidy contract being developed between Exelon and the state Energy Research and Development Authority. "We haven't seen the contract," said Jessica Azulay of the Alliance for Clean Energy. The subsidies concept was agreed upon earlier in the year with approval of the state's new Clean Energy Standard. Put forward by Gov. Andrew Cuomo, the standard aims to get 50 percent of the state's energy production from renewables by 2030. The state has estimated the subsidy to cost ratepayers about $2 per month although that could drop as power prices rise in future years. The deal puts Chicago-based Exelon in control of upstate New York's nuclear power plant fleet.
