This recently came to our attention in a big way when DA user discovered that his Adventure Time fanart was being sold on Hot Topic without his knowledge.
fizz hoodies coloursThe modified licensing agreement goes like this:As and when Artist Materials are uploaded to the deviantART Site(s), Artist grants to deviantART a worldwide, royalty-free, non-exclusive license to do the following things during the Term:d) the right to sublicense to any other person or company any of the licensed rights in the Artist Materials, or any part of them, subject to the terms and conditions of this Agreement.BUT... there is supposedly a saving grace here...5. Limitation Of Rights The rights and licenses granted to deviantART under sections 3 and 4 of this Agreement require deviantART to obtain Artist consent before deviantART makes any commercial agreement with anyone else to separately buy, license, re-sell or re-publish or commercially use any Artist Materials not in association with deviantART but as an individual work of art or as a group of works from a single Artist in isolation from any other works.

So for the matter involving poor I think this kinda ends it. They were not contacted, so the chances are this was not DA licensing it to Hot Topic, but instead just Hot Topic being the nasty and blatant art thieves that they are.Unless of course this is DA being an underhanded prick... which is also entirely possible.Been there, done that... not worth the effortIn any case, I am not here to argue for or against . They’ve already made it clear that they aren’t all that interested in fighting to get the shirt taken down, and I’m in the same boat as him. I’ve had my art stolen, reposted, reblogged, slapped on merchandise and sold on T-shirts, posters, ebay, etc. There’s only so much you can do before you just can’t keep fighting... and it’s sadly depressing that the best course of action IS to let this shit continue to happen so you can get back to focusing on your art.What you can do about itBut don’t let this stop you from thinking DA is in the clear or that it’s OK for companies to do this.

And there are a number of ways to prevent it. I’m just going to copy/paste tumblr user scribblingaladdertothemoon‘s list for you all to read here: scribblingaladdertothemoon.tum…For those of you who are interested in keeping your deviantart accounts but hate the terms and conditions and do not want taken advantage of, here’s a few tips to protect yourself:    1) Never upload the original file size. Always upload your pictures at 72dpi, JPG format, and no more than about 500px wide. This will give them a lower quality image to work with if they want to try to steal your work. Unless they want to print stamps, they will be forced to resize the image, thus creating a low-quality product.    2) Direct your users to other websites to order prints of your work that have safer terms and conditions or open your own print store on Etsy or StoreEnvy.    3) Watermark it with your own personal watermark. Do not use deviantart’s watermarking system. Place it on the picture so they would have to crop out a large portion of the artwork to crop it out.   Â

4) Add a signature to your work, even if it is a photograph.     5) If you want to offer the art/photo/file for download, host it on another website. Do not use their Stash option to store files.I’m growing more and more impatient with DA as the months go by. On the one hand I REALLY want to get off this website. I’ve been here for 10 years and I just want to venture out and not have to worry about crap like this. But at the same time I acknowledge that it would essentially be career suicide to do so because my largest fanbase and watcher list exists here on DA. Cutting all ties would be detrimental to my career, to the point that I doubt I’d ever recover. So I don’t want to leave... but I do... but I don’t... and it’s just... ughhhhhhSo what’re your thoughts on all this? Have better solutions or advice?
