Community members had pressed for criminal charges against Sgt. Jeffrey Rothecker after his comment, which he posted under the screen name “JM Roth” before a Jan. 18 unpermitted protest involving Black Lives Matter St. Paul.

The post referred to protesters as “idiots” and detailed what drivers could do to avoid being charged with a crime if their vehicles struck someone during the march. Rothecker resigned from the police department Feb. 17, amid an internal investigation of the comment. The city of St. Paul paid Rothecker $7,500 in exchange for his agreeing to not sue and waiving all claims, including under the Minnesota Veteran’s Preference Act, according to the agreement, which Rothecker signed Feb. 17 and was made public Friday at the Pioneer Press’ request. Rothecker had been on paid administrative leave, and his resignation halted any discipline he could have faced. But had he stayed on as an employee and been disciplined, he would have had the right to appeal it and the city would have been legally required to pay him during that time. St. Paul determined it would have been on the hook for more than the amount reached in the agreement, said Jason Schmidt, the city’s labor relations manager.

For honorably discharged veterans — including Rothecker, an Army veteran — the state’s Veterans’ Preference Act would have called for more due-process steps, had Rothecker been disciplined and he appealed it. The process “can easily take a year,” during which the city would pay Rothecker his $93,000 salary , Schmidt said. The attorney for the St. Paul police union said Friday that the agreement spoke for itself and he had no additional comment. Rothecker could not be reached. Nathaniel Khaliq, former St. Paul NAACP president, had been among those who called for Rothecker to be charged. He said Friday he was disappointed in the city attorney’s decision. “It seems with cases like this, that are very egregious, they are violating the public trust … and he pretty much gets to walk away,” Khaliq said. St. Paul City Attorney Samuel Clark said his office had looked at it “from every angle.” “The mayor has repeatedly reiterated his disgust for the comments, and I share his feelings,” he said in a statement to the Pioneer Press.

“Mr. Rothecker’s comments were outrageous and hurtful, to be sure, but that does not necessarily mean that a crime occurred.” Clark said several experienced prosecutors in his office researched applicable laws and he talked informally to his counterparts in other jurisdictions about whether Rothecker’s comments could be considered criminal. “The criminal statute that most closely matches what happened in this case is disorderly conduct, which makes it a misdemeanor to engage in ‘offensive, obscene, or abusive language tending reasonably to arouse alarm, anger, or resentment in others,’ ” Clark said. “I understand how people could read that and question why Mr. Rothecker comments don’t fit the bill. But the Minnesota Supreme Court has ruled that part of the statute unconstitutional unless limited to fighting words which are (1) personal insults that are inherently likely to provoke a violent reaction or (2) words that are intended to and likely to incite immediate unlawful action.

Mr. Rothecker’s comments do not meet either standard.” Khaliq said he also thinks the city should not have let Rothecker resign. “He should have been fired, if took six days or six weeks or six months,” he said. “They could have done a thorough investigation to find out if any of his supervisors or others were aware of his comments.” Under the American legal system, people can quit their jobs whenever they want. The St. Paul police union contract specifies that a terminated employee cannot collect severance. Both employees who resign and are terminated get their comp time paid out and their vacation time put in a post-employment health plan (similar to a flexible spending account for medical expenses) because those are benefits previously earned, Schmidt said. When Rothecker resigned, the city paid out his comp time — he had accrued 94 hours, which amounted to $4,227, a city document showed. Rothecker had nearly 140 hours of vacation remaining, which resulted in about $6,200 put in his post-employment health plan, according to Schmidt.
